9. REDEVELOPMENT - SUCCESSOR AGENCY

9.1 Amendment to the Reimbursement Agreement with JP Morgan Chase Bank.

(a) Council, acting as the Successor Agency to the Redevelopment Agency of the City of San José, by motion waive the 10-day noticing requirement for the following item, approve its placement on the agenda, and consider the following recommendation.

(b) Adopt a resolution by the City Council, acting as the Successor Agency to the Redevelopment Agency of the City of San José, authorizing the Executive Officer to negotiate and execute the Fifth Amendment to the Reimbursement Agreements with JP Morgan Chase, Bank NA ("JPMorgan") with a term for less than one year, with all other terms and conditions previously approved by on May 22, 2012 to remain unchanged. (Order of the Day) REQUIRES A DETERMINATION BY A TWO-THIRDS (2/3) VOTE OF THE MEMBERS OF THE COUNCIL PRESENT AT THE MEETING, OR, IF LESS THAN TWO-THIRDS (2/3) OF THE MEMBERS OF THE COUNCIL ARE PRESENT AT THE MEETING, A UNANIMOUS VOTE OF THOSE MEMBERS PRESENT THAT THERE IS A NEED TO TAKE IMMEDIATE ACTION. 4.1 Historic Landmark Nomination and Mills Act Historical Property Contract for the "Geer House".

(a) Conduct a public hearing and adopt a resolution designating the "Geer House" as a landmark of special historic, architectural, cultural, aesthetic or engineering interest or value of an historic nature.
